1. About these terms and who we are
1.1 These terms apply to your use of the website at dunedynamics.ai and its pages (the “website”). By using the website you agree to them. If you do not agree, please do not use the website.
1.2 The website is run by Dune Dynamics Digital Consulting FZCO, a free zone company in the United Arab Emirates, licensed by the International Free Zone Authority (IFZA), Dubai under licence number 78955, with its registered address at Premises 78955-001, IFZA Business Park, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates. In these terms, “we”, “us” and “our” mean Dune Dynamics Digital Consulting FZCO, and “you” means the person using the website and, where you use it for your work, the organisation you represent.
1.3 These terms cover the website only. If your organisation subscribes to AgentFlow or Navigator, that subscription is governed by the separate customer agreement signed with us, and these terms do not apply to it. If the customer agreement and these terms ever conflict, the customer agreement prevails for anything it covers.
1.4 Our Privacy Policy explains how we handle personal data collected through the website, and our Website Disclaimer explains how to read the product descriptions and sample content on the website. Both should be read together with these terms.
2. Using the website
2.1 The website is meant for businesses that want to learn about our products and get in touch with us. You may browse it, read it and contact us through it for that purpose.
2.2 When you use the website, you agree that you will:
- use it lawfully and in line with these terms;
- give accurate details when you fill in a form, including your own work email address;
- not copy, scrape, crawl or extract content from the website by automated means, other than ordinary indexing of public pages by search engines, without our written permission;
- not scan, probe or test the website or our systems for vulnerabilities, carry out penetration or load testing, or try to get round any security measure, without our written permission;
- not try to access any part of the website, our servers or our systems that is not publicly available to you;
- not upload or send anything that contains viruses or other harmful code, or that could damage, overload or interfere with the website;
- not use the forms to send unsolicited marketing, or pretend to be another person or organisation.
2.3 If you think you have found a security weakness in the website, please tell us at privacy@dunedynamics.ai and do not test it further. We are grateful for responsible reports.
2.4 We may block or restrict your access to the website if we reasonably believe you have broken these terms.
3. Information you send us
3.1 You can send us information through the website, for example when you book a live demo or ask for our security and architecture pack. We handle any personal data in that information as described in our Privacy Policy.
3.2 You must have the right to share anything you send us. If you send information about other people, or information that belongs to your organisation or to someone else, you are responsible for making sure you are allowed to share it with us.
3.3 Please do not send us personal data about other people, such as recordings or transcripts of conversations with your customers, unless it has been anonymised so that no one can be identified from it, or we have first agreed in writing how it will be handled (for example in a data processing agreement or a pilot agreement). If you would like to see Navigator score one of your own transcripts during a demo, or would like us to check dialect coverage against your own recordings, contact us first and we will agree the right arrangement with you before you send anything.
3.4 Please do not send bank account or card numbers, passwords, health or insurance claim details, or other sensitive information through the website forms.
3.5 If you want to share confidential business information with us before a contract is in place, ask us for a non-disclosure agreement first.
3.6 If you send us ideas or feedback about our products, we may use them to improve our products and services without any obligation to you.
4. The security and architecture pack and other materials we share with you
4.1 This section applies to the security and architecture pack and to any other material we share with you that is not on the public pages of the website, such as architecture diagrams, proposals, pricing, demo recordings and assessment documents (together, “materials”).
4.2 The materials are confidential. You may use them only to evaluate Dune Dynamics as a possible supplier to your organisation.
4.3 You may share the materials with colleagues and professional advisers who need them for that evaluation, as long as they keep them confidential on the same terms. You must not publish them, post them online, sell them or pass them to anyone else without our written permission.
4.4 Some materials, including certification and assessment reports, are shared only under a separate non-disclosure agreement. Where you or your organisation have signed a non-disclosure agreement with us, that agreement governs the materials it covers, and this section applies to anything that agreement does not cover.
4.5 This section does not restrict information that is already public through no fault of yours, that you already had or developed independently, or that you received lawfully from someone else without a duty of confidence.
4.6 If we ask, you must delete or return the materials, except for copies you are required by law to keep or that sit in routine backups, which remain confidential.
4.7 The materials describe our products and practices on the date we share them, and they may change.
5. Intellectual property
5.1 We, or the people who license material to us, own the intellectual property rights in the website and its content, including text, graphics, page designs, sample conversations, sample dashboards and software.
5.2 You may view the website and print or download a reasonable number of pages for your own internal evaluation of our products. You must keep any copyright and other notices on them. You must not otherwise copy, adapt, republish or distribute the content, use it to build a competing product, or use it to train machine learning models, without our written permission.
5.3 Dune Dynamics, AgentFlow and Navigator, and our logos, are our trade marks. You may use our product names to refer accurately to our products. Any other use needs our written permission.
5.4 Names, logos and trade marks of other companies that appear on the website belong to their owners. Their appearance does not mean that those companies endorse us or are connected with us, unless we say so.
6. No offer and no professional advice
6.1 The content of the website is general information about Dune Dynamics and our products. Nothing on the website is an offer to supply products or services that you can accept. We supply AgentFlow and Navigator only under a signed customer agreement, and what we supply, and on what terms, is set out in that agreement.
6.2 How our products work for a customer depends on how they are deployed and configured and on the customer's own systems. Our Website Disclaimer explains this and explains that the sample conversations, scores and metrics on the website are illustrative.
6.3 Nothing on the website is legal, regulatory, compliance, financial or security advice. Descriptions of data residency, regulation or security controls are general. You should take your own advice on what your organisation needs.
7. Third-party links
7.1 The website may contain links to websites run by other people. We do not control those websites and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.
8. Availability and changes to the website
8.1 We may update, change, suspend or withdraw any part of the website at any time, for example to reflect changes to our products. We try to keep the website available and accurate, and we do not promise that it will always be available, free of errors or up to date.
8.2 You are responsible for your own devices and internet connection, and for using suitable virus protection.
9. Disclaimer of warranties and limitation of liability
9.1 We provide the website and its content free of charge and “as is”. To the extent the law allows, we give no promises or warranties about the website or its content, including about its accuracy, completeness, fitness for a particular purpose or freedom from viruses.
9.2 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law that applies.
9.3 Subject to section 9.2, we are not liable to you for any loss of profit, revenue, business, contracts, goodwill or data, or for any indirect or consequential loss, arising out of or in connection with your use of the website or your reliance on its content.
9.4 Subject to section 9.2, our total liability to you arising out of or in connection with the website and these terms is limited to AED 500.
9.5 This section applies to the website only. Our liability to customers for AgentFlow and Navigator is set out in the customer agreement.
10. Indemnity
10.1 If you use the website in breach of these terms or the law, and another person brings a claim against us as a result, you will reimburse us for the reasonable losses and costs (including reasonable legal fees) we incur because of that breach.
11. Changes to these terms
11.1 We may update these terms from time to time, for example to reflect changes to the website, our products or the law. We will post the updated terms on this page and change the “Last updated” date at the top. The terms in force when you use the website are the ones that apply, so please check this page from time to time.
12. Governing law and disputes
12.1 These terms, and any dispute or claim arising out of or in connection with them or the website, are governed by the laws of the Dubai International Financial Centre.
12.2 If you have a complaint about the website, please contact us first so that we can try to resolve it. If we cannot resolve it within 30 days of your contacting us, either of us may refer the dispute to the Courts of the Dubai International Financial Centre, which will have exclusive jurisdiction.
